TERMS & CONDITIONS

1. Platform Information
FlowerFinder ("FlowerFinder", "we", "us") operates the online marketplace available at https://www.flowerfinder.be (the "Platform"). FlowerFinder enables customers to purchase floral products from independent local flower shops ("Partner Shops").
FlowerFinder is responsible for:
- Operating the Platform
- Processing customer payments
- Organising delivery and logistics
- Transferring payments to Partner Shops
Partner Shops are responsible for preparing and supplying the products.
2. Applicability
These Terms & Conditions apply to all users of the Platform, including customers and Partner Shops. By using the Platform or placing an order, you agree to these Terms.
3. Orders and Contract Formation
When a customer places an order via the Platform:
- A sales contract is formed between the customer and the Partner Shop
- FlowerFinder acts as a commercial intermediary and logistics coordinator
FlowerFinder confirms orders electronically. Partner Shops accept orders by preparing the products for delivery.
4. Prices and Payments
All prices displayed include applicable VAT unless stated otherwise.
Payments are processed securely by FlowerFinder via Mollie. FlowerFinder collects payment from the customer and transfers the relevant amount to the Partner Shop, minus applicable commissions or service fees.
Mollie acts as an independent data controller for payment-related personal data. Mollie's processing of personal data is governed by its own privacy policy.
5. Delivery
FlowerFinder organises delivery to the address provided by the customer.
Delivery times are estimates. FlowerFinder makes reasonable efforts to ensure timely delivery but is not liable for delays caused by force majeure or incorrect delivery information.
6. Right of Withdrawal & Perishable Goods
Due to the nature of the products offered on the Platform, certain goods have a limited lifespan, including flowers and floral arrangements.
In accordance with Article VI.53 of the Belgian Code of Economic Law, the statutory right of withdrawal does not apply to goods that are made to order or are perishable.
Delivery, Acceptance & Proof
Upon delivery, the courier records the delivery status in the delivery system and takes a photographic proof of delivery to document the condition of the order at the time of delivery.
- If the customer accepts the delivery, the courier registers the order as "accepted" in the delivery scanner.
- If the customer believes the order is damaged, defective, or incorrect, the customer must immediately refuse the delivery upon receipt. In this case, the courier registers the order as "not accepted".
Returns, Refunds & Complaints
Returns or refunds are not accepted for perishable goods once the delivery has been accepted.
If an order is marked as "not accepted" due to damage, defect, or incorrect content, the customer will receive a full refund within three (3) working days using the original payment method.
If the customer accepts the delivery, any later claims regarding damage or incorrect delivery cannot be accepted, as the acceptance confirms that the order was received in satisfactory condition.
7. Complaints and Disputes
- Customer complaints should be submitted via hello.flowerfinder@gmail.com.
- FlowerFinder will mediate between customers and Partner Shops where appropriate.
- Belgian law applies. Disputes fall under the jurisdiction of the courts of Belgium.
8. Liability
FlowerFinder is not liable for:
- Product quality issues attributable to Partner Shops
- Indirect or consequential damages
FlowerFinder's liability is limited to the amount paid by the customer for the relevant order, except in cases of gross negligence or mandatory legal liability.
9. Intellectual Property
All content on the Platform remains the property of FlowerFinder or its licensors and may not be used without permission.
10. Changes
FlowerFinder may update these Terms at any time. Updated versions will be published on the Platform.
PARTNER SHOP PRIVACY ANNEX
1. Roles under GDPR
FlowerFinder acts as primary data controller for customer data collected via the Platform.
Partner Shops act as independent data controllers for customer data shared with them for order fulfillment.
2. Data Shared with Partner Shops
Partner Shops receive only the data necessary to fulfill orders:
- Customer name
- Delivery address
- Order details
- Delivery instructions
3. Partner Shop Obligations
Partner Shops must:
- Process personal data solely for order fulfillment
- Implement appropriate security measures
- Not use customer data for marketing unless lawful consent exists
- Delete or anonymize data when no longer required
4. Data Processing Agreements
Partner Shops agree to enter into a Data Processing or Data Sharing Agreement with FlowerFinder where required by GDPR.

1. What Are Cookies
Cookies are small text files stored on your device to ensure website functionality and improve user experience.
2. Types of Cookies Used
- Strictly necessary cookies: required for platform operation
- Functional cookies: remember preferences
- Analytical cookies: analyze platform usage
- Marketing cookies: only used with consent
3. Cookie Consent
- Non-essential cookies are placed only after user consent via the cookie banner.
- Users may withdraw consent at any time via browser settings.
4. Third-Party Cookies
Third-party services such as analytics or payment providers may place cookies in accordance with their own privacy policies.
